Drunk Driver's Fatal BMW Crash Leads to Decade-Long Prison Sentence

A drunk driver who screamed "I killed the dude" after flipping his powerful BMW onto its roof, resulting in the death of his friend, has been sentenced to ten-and-a-half years in prison. Mariusz Kosinski, 37, from Evesham, Worcester, was convicted of causing death by dangerous driving following a horrific incident on July 27, 2024.

Reckless Driving and Alcohol Excess

Kosinski was seen driving on the wrong side of the street in Evesham, Worcester, before losing control of his black BMW 330d. The court heard that he had been overtaking dozens of vehicles, with witnesses reporting screeching tyres as he sped past 14 cars and two motorbikes. His dashcam footage captured the moment he lost control, causing the car to spin and flip onto its roof on a grass verge along the A46.

Immediately after the crash, Kosinski was recorded screaming in Polish: "F***! He is dead, mate! I killed the dude. F***! Buddy! I killed him!" His passenger and friend, Pawel Czubacki, 40, died in the passenger seat despite the efforts of emergency services who rushed to the scene. A breathalyser test revealed Kosinski had 80mcg of alcohol per 100ml of breath, more than twice the legal limit of 35mcg.

Court Sentencing and Police Response

At Worcester Crown Court, Judge Nicholas Cartwright stated that Kosinski deliberately ignored the rules of the road and showed a disregard for the safety of other road users while "showing off." In addition to the prison sentence, Kosinski was banned from driving for 13 years. The judge emphasized the severity of the offense, noting that Kosinski's actions were not a momentary lapse but part of a pattern of risky driving.

Detective Constable Danny Somner of West Mercia Police commented: "We are pleased to get this conviction and sentencing for Kosinski today whose appalling driving resulted in the tragic death of his passenger and put many other motorists at risk of serious harm that day. The footage recovered from Kosinski's dashcam showed his usual driving was risky and dangerous, so it is right he is behind bars and has been handed a lengthy ban from the roads."
