James Holder, the co-founder of the clothing brand Superdry, has been sentenced to eight years in prison for raping a woman in her flat in Cheltenham, Gloucestershire, following a night out in May 2022.
Details of the assault
The 54-year-old, who resided in Cheltenham, had originally planned to take a taxi home with a male friend after a night out. Instead, the pair entered the victim's taxi and accompanied her to her apartment, where Holder proceeded to rape her. During the trial, the jury heard that the victim repeatedly asked Holder to stop, but he continued even as she began to cry. The court also noted that the woman was particularly vulnerable due to her level of intoxication.
Victim impact statement
In a powerful statement read out in court, the victim described how Holder acted as if he was entitled to her body. She said: "You chose to take what was never yours – my choice, my dignity, my body. It is four years since you raped me. I have not softened that word to make it easier for you or anyone else to hear." She added that the assault had deeply affected her relationships and self-esteem, stating, "I have struggled to see the good in myself at times and at times failed to recognise the value I bring." The victim also highlighted that Holder entered her home uninvited and ignored her pleas to stop, violating her sense of safety.
Legal proceedings and sentencing
Holder, who appeared via video link from prison wearing a grey sweatshirt and trousers, showed no reaction during the statement. He had admitted to sexual activity but claimed it was consensual. However, a jury at Gloucester Crown Court, sitting in Cirencester, found him guilty of rape last week. The judge, David Chidgey, praised the victim for her bravery in giving evidence and described the attack as a "living nightmare." He noted aggravating factors, including that the assault occurred in her home and that Holder had not been invited. Chidgey called Holder's actions "despicable" and said the offence was about entitlement, with a casual disregard for the victim's right to control her own body.
Mitigation and previous conviction
In mitigation, Holder's barrister, Michelle Heeley KC, argued that his wife and two children would also suffer from his sentence, and that his children would lose a father figure. She highlighted Holder's business achievements, including building companies that employed thousands, and his charitable work. Heeley also noted that Holder had asked to train young people in fashion and design while in prison, and that his high-profile case and wealth made him a target in jail. The judge dismissed Holder's application for bail to put his affairs in order, citing a flight risk due to his significant resources. Holder had one previous conviction for drink-driving in 2023.

Holder, a graphic design student, initially founded the skateboarding and BMX fashion label Bench. In 2003, he co-founded Superdry with Julian Dunkerton, starting from a market stall in Cheltenham. The first physical store opened in Covent Garden, London, in 2004, and the brand now has over 60 stores in the UK and many more worldwide. Superdry has confirmed that Holder had no role in the company at the time of the offence.
