Network Rail Employee Triumphs in Landmark Race Harassment Tribunal

A Network Rail employee has successfully won a significant race harassment case following a disturbing campaign of workplace intimidation that included colleagues placing an anti-Islam English Defence League leaflet in his personal locker.

Targeted Campaign of Racial Harassment

Parmjit Bassi, based at the Eastleigh depot in Hampshire, was subjected to what an employment tribunal described as "clear slights" against his race, despite not being a Muslim. The tribunal heard that in November 2018, Bassi discovered a leaflet produced by the far-right EDL group in his work boots, which were stored in his locker.

The inflammatory leaflet asked "what individuals were doing to protect their children from Islam" and was determined by the tribunal to be a deliberate attempt to degrade Bassi based on his racial background. The Southampton employment tribunal concluded that the perpetrators drew no distinction between Bassi and Muslims, simply lumping him together with what they perceived as a dangerous "other."

Escalating Intimidation and Management Failure

The harassment escalated dramatically in January when Bassi returned from annual leave taken to distance himself from the toxic work environment. Two copies of a national newspaper with the headline "Knifed Nine Times" were discovered in the office, one accompanied by a knife in a kitchen drawer and the other again found in Bassi's boot.

Both copies featured a handwritten note in marker pen stating "It was Parm," directly accusing Bassi of committing a high-profile stabbing. The tribunal heard that Bassi's manager sent him home on full pay "for his own welfare" following this incident, but the response was deemed inadequate.

The tribunal strongly criticized Network Rail's management approach, describing their "laissez-faire attitude" as "very hard to comprehend." One manager admitted that more should have been done to address the situation, with the tribunal noting that "to do nothing was weak management and only strengthened the bullies' position at the expense of Mr. Bassi."

Systemic Workplace Failures

The tribunal determined that Bassi had been systematically ostracized within his workplace, with the leaflet incident representing "a further manifestation of somebody within the team or some bodies indicating that they did not want Mr. Bassi at work." The panel emphasized that "there is a very clear racial message contained within" the harassment campaign.

Despite being moved to work on a different team without his input, Bassi continued to struggle in his role and was eventually dismissed in April 2021. His appeal against the dismissal was upheld, leading him to take Network Rail to the employment tribunal with multiple claims.

Successful Legal Outcome

Bassi's claims of racial harassment and unfair dismissal were both successful at the Southampton employment tribunal, putting him in line to receive compensation for the discrimination he endured. The tribunal ruled unequivocally that the incidents constituted racial harassment and intimidation as part of an ongoing campaign by one or more colleagues.

The case highlights serious concerns about workplace culture and management responses to racial harassment within major infrastructure organizations. The tribunal's findings underscore the responsibility employers have to actively address discriminatory behavior and protect employees from targeted campaigns of racial intimidation.
