Cardiff City's Compensation Bid Over Emiliano Sala's Death Dismissed by French Court
In a significant legal setback, Cardiff City has lost its compensation claim against French club Nantes regarding the tragic plane crash that killed footballer Emiliano Sala in January 2019. The French court ruled against the Welsh club, which had sought over £100 million in damages for alleged negligence connected to the fatal incident.
Details of the Court Ruling and Financial Penalties
The court found Nantes not at fault for the crash, which also claimed the life of pilot David Ibbotson. It described Cardiff's claim as "extravagant" and stated that Cardiff did not suffer any reputational harm, while noting that Nantes had experienced damage to its reputation. As a result, Cardiff was ordered to pay €300,000 in damages and €180,000 in legal costs, totaling approximately £416,000.
This ruling adds to Cardiff's legal woes in the long-running case. Previously, the club was compelled to pay the £15 million transfer fee for Sala after a separate claim that the deal was incomplete was rejected. Sala, a 28-year-old Argentine forward, had been signed for a club-record fee but never played for Cardiff after the light aircraft crashed into the English Channel en route to begin his Premier League career.
Background on the Crash and Legal Arguments
Cardiff contended that Nantes was responsible because they enlisted agent Willie McKay, whose son Mark McKay represented Sala, to arrange the flight. Nantes denied this allegation, and the court upheld their position. In 2021, David Henderson, who arranged the flight, was convicted of endangering aircraft safety and sentenced to 18 months in prison. He had hired Ibbotson, who lacked a commercial licence, night-flying qualification, and an expired rating for the Piper Malibu aircraft.
An inquest revealed that Sala likely lost consciousness due to carbon monoxide poisoning from a faulty exhaust system. While Sala's body was recovered weeks after the crash, Ibbotson's remains have never been found.
Cardiff City's Response and Ongoing Legal Battles
In a statement released on Monday, Cardiff City expressed deep regret over the court's decision, stating, "We initiated these proceedings so that the full truth of this case could come to light, in respect of Emiliano Sala's memory." The club lamented that principles of transparency, integrity, and safety in professional football were not upheld in the ruling.
This case underscores the complex legal and emotional aftermath of the Sala tragedy, with Cardiff continuing to face financial and reputational challenges years after the incident.
