A heartbreaking inquest has heard how a 12-year-old girl, described by her family as "beautiful" and full of life, tragically died after being struck by a falling branch while playing on a rope swing. The incident occurred in Banstead, Surrey, just days before her 13th birthday on November 9, 2024.

Tragic Incident and Fatal Injury

Brooke Wiggins, also known as Brooke Etherington, was playing on a rope swing when a branch snapped from the tree she was swinging on. The impact caused a fatal injury that led to her death. South London Coroner's Court heard the devastating details during proceedings on Wednesday.

The court learned that the tree, which was maintained by Surrey County Council, had been inspected in May 2022 and was due for re-inspection in May 2024. However, this crucial inspection never took place, raising serious questions about maintenance protocols and safety oversight.

Family's Heartbreaking Statements

In a statement read by assistant coroner Ivor Collett on behalf of Brooke's mother, Claire Etherington, the young girl was described as a "beautiful, fun, caring and loving girl" who had "the most incredible way of lighting up every room she went into."

"She was always surrounded by the people who loved her, and it's easy to see why – she gave so much love back," her mother said through the statement. Brooke was passionate about dancing, art, singing, and photography, and took great pride in expressing herself creatively.

"She was a smart girl with so much potential," Ms. Etherington continued. "We will always wonder what she would have gone on to achieve in her life." The mother expressed hope that understanding what happened to Brooke might bring "a small sense of closure" to the family.

Father's Devastating Testimony

In a separate statement read by Mr. Collett, Brooke's father, Lee Wiggins, told the inquest his daughter was an "amazing young woman" who was "bright" and "very funny."

"I am devastated that my baby girl has been taken from me," Mr. Wiggins said. "She packed so much into her short life. Only 12 years old, and now she's gone forever. When I think of her, I ask myself, 'why my darling Brooke?'"

The grieving father added a pointed criticism: "If only people had done their job properly... the one thing they are paid to do, and did it properly, Brooke would still be here."

Legal Proceedings and Council Response

Acting on behalf of Brooke's father, Christian Weaver argued that had the scheduled inspection been carried out, any rope swing found on the tree should have been removed "as per policy." This raises significant questions about whether proper procedures could have prevented the tragedy.

Representatives for Surrey County Council responded that expert evidence suggests an inspection might not have achieved a "material different outcome," though this claim was presented in the context of ongoing legal proceedings.

Coroner's Sympathetic Approach

Speaking at the start of the hearing, Mr. Collett acknowledged the particularly tragic nature of the case. "This is a particularly sad inquest," he said. "Of course, there are no happy inquests, but this is dreadful because it concerns the death of a young child and there's no escaping that."

The assistant coroner directly addressed the family's pain, saying: "To the family, I am bound to sound, at times, rather cold and distant... (but) I do not take away for a moment the unending pain felt by the family by the loss of their beloved daughter."

The inquest continues as authorities seek to determine the full circumstances surrounding this tragic incident that has left a family and community in mourning.
