William Malcom, the ICO's executive director of regulatory risk and innovation, emphasised the gravity of the situation: "The reports about Grok raise deeply troubling questions about how people's personal data has been used to generate intimate or sexualised images without their knowledge or consent, and whether the necessary safeguards were put in place to prevent this."

Regulatory Powers and Potential Consequences

Under the UK's comprehensive data protection framework, which includes the UK GDPR and Data Protection Act 2018, the ICO possesses substantial enforcement powers. The regulator can impose significant financial penalties, including:

  • Fines of up to £17.5 million
  • Alternatively, 4 per cent of an organisation's annual worldwide turnover
  • The higher of these two amounts would apply in enforcement cases

The ICO confirmed it is "working closely with Ofcom" alongside international regulatory bodies in a coordinated approach to address these concerns. This collaboration comes as Ofcom, the UK's communications regulator, has separately initiated its own investigation into whether Musk's X platform has taken sufficient measures to protect British users from explicit deepfakes generated by the Grok AI system.

Ofcom issued a clarifying statement on Tuesday, noting that while it is not currently investigating X.AI directly, it is examining whether to launch a formal investigation into whether Grok's owners comply with regulations concerning pornographic material. The media watchdog is currently in the evidence-gathering phase of its investigation, requesting information and analysing available data before potentially progressing to the next stage of issuing a provisional decision.
